Fire Risk Assessments
In England and Wales, if you are an employer, owner, landlord or occupier of a business or other non-domestic premises, you are responsible for fire safety and are known as the ‘responsible person’. As the responsible person, you must comply with the Fire Safety Order, enforced by your local fire authority, or risk severe penalties:
- Carry out a regular fire risk assessment of your premises.
- Identify risks and ensure everyone is aware of them.
- Put in place and maintain appropriate fire safety measures to remove or reduce the fire risks.
- Have an adequate fire emergency plan in place should a fire occur.
- Ensure that all staff are aware of fire safety instructions and provide training where necessary.
Your local fire and rescue authority will visit your premises to check that your fire risk assessment and fire prevention measures are appropriate. They also have the authority to take action if they believe your fire safety methods are not sufficient. You could receive one of several notices:
- Alterations
- Enforcement
- Prohibition
If you do not comply and take action based on the fire service's recommendations the penalties range from up to £5000 fine (for minor incidents), or major fines and up to 2 years’ imprisonment in more severe cases.
